Feds investigate Houston ISD for plans to separate students with disabilities

Houston school officials are facing a federal investigation after proposing a plan to separate students with disabilities from their general education peers. The district argues the move is designed to provide more focused, individualized support for children who require intensive services. Administrators say grouping these students together in dedicated classrooms will allow specialized staff to deliver targeted instruction without the distractions of a larger, mixed setting.

However, the U.S. Department of Education has opened a civil rights probe, questioning whether the proposal violates federal laws that protect students with disabilities from being isolated or segregated. Federal investigators worry the plan could create a separate and unequal educational track, denying these children the opportunity to learn alongside their nondisabled classmates. Under the Individuals with Disabilities Education Act, schools must place students in the least restrictive environment possible, meaning they should only be removed from regular classes when their needs cannot be met with appropriate aids and supports.

The investigation will examine whether Houston ISD has provided sufficient justification for the separation and whether it has exhausted all options for inclusion. Parents and advocacy groups have voiced sharp divisions, with some welcoming the idea of more intensive care and others fearing a return to outdated segregation practices. The district has pledged to cooperate with the inquiry while defending its approach as a matter of student well-being.
